Mediation Added to Currie & Brown’s Contract Advisory Service


Global asset management consultant Currie & Brown has added mediation to its international range of contract advisory services in the United Arab Emirates.

Director Edward McCluskey, who leads the Group Contract Advisory Services’ team, has been accredited by the internationally-recognised Centre for Effective Dispute Resolution (CEDR) mediator course. He is among a small number of CEDR accredited mediators in the UAE region.

The addition of mediation to the Group’s advisory services comes as construction related disputes in the marketplace are rising. Having recently represented a major UK client in a landmark adjudication case, the team is focused on developing dispute resolution services to clients in the UAE.

"Mediation is an increasingly important means of settling disputes, especially given the high costs and time spent if a case escalates to court or formal arbitration,” commented Edward McCluskey.

“It is vital that we have added this discipline to the range of expertise that we have within the Contract Advisory Service. Clients rely on us to provide high quality advice and support.”

Currie & Brown’s team successfully represented Bell Group during the adjudication case which involved a complex dispute between Bell Group, the UK's largest independent commercial and industrial painting firm, and facilities service company Dalkia. The dispute concerned payment for repair and painting works at 143 railway stations and 22 footbridges across the UK.

Together with the legal representatives, the Contract Advisory Team subsequently secured an award from the adjudicator, granting Bell Group all of its substantive claims, together with associated costs incurred in the adjudication process, and a punitive interest award. The total awarded was £300,000.

.Edward added: “In the case of Bell Group, we enjoyed a resounding victory in what was a very demanding and complex case. This case was particularly unusual in that the adjudicator’s jurisdiction was challenged in court at such a late stage during the process."
